Acceptance of terms

To book a tour or event with Nicola Jane Corporate you are required to pay a deposit as specified by your personal event manager. By placing this deposit you confirm the accuracy of all information you have provided and accept our terms and conditions on behalf of yourselves and all of your party. The agreement between yourself and Nicola Jane Corporate commences once your booking has been confirmed in writing by Nicola Jane Corporate and a confirmation number has been issued. Unless you advise us to the contrary we will assume that every member is over the age of 21 years. Written confirmation within 48 hours of receiving Nicola Jane Corporate’s confirmation number is required should you not agree with any of the terms and conditions or to the contract terms. The terms and conditions and general information constitute the entire agreement between you and Nicola Jane Corporate. It must be understood that those booking via telephone or e-mail accept our booking terms and conditions.

Payment Details

If you are booking a tour or event more than 5 weeks before the date of the tour/ event, you must pay a deposit of £30 per person unless specified otherwise by your personal event manager. Any deposit paid by you will not be refundable. The balance of the sum due must be paid at least 5 weeks before the date of the tour/event and if you should fail to make this payment the deposit will be retained and Nicola Jane Corporate will consider the tour cancelled.
If you book a tour /event within 31 days of the date of the tour, the full cost of the tour is immediately payable. All AMEX card payments will carry a 3% processing surcharge & all other credit cards will be subject to a 2.5% surcharge. Some events have minimum group sizes and this will reflect in the cost of your package should your group fall below these numbers. After the final payment date as detailed in your booking confirmation all monies are non-refundable.

Changes

Nicola Jane Corporate always aim to operate all the tours and arrangements as advertised and booked. By entering into a booking with Nicola Jane Corporate and accepting our terms and conditions the client accepts that it may prove necessary or advisable to vary or modify an itinerary or its contents due to prevailing local conditions.

Nicola Jane corporate reserves the right at any time to cancel or change any of the facilities, services or prices, including and not limited to flights, accommodation, activities, restaurants, entertainment venues, transfers and to substitute alternative arrangements of comparable monetary value without compensation and accepts no liability for loss of enjoyment as a result of these changes.

We will always endeavour to notify you of any changes as soon as possible. However, under no circumstance are we obliged to cancel or refund any element of a weekend cancelled due to riots, war/threat of war, terrorist activity, industrial disputes, fire, natural disasters, airport closures (delayed flights), bad weather conditions and similar events beyond our control.

All accommodation that we use is advertised and booked in twin rooms, unless otherwise stated. However, subject to changes in numbers and most suitable configurations, we reserve the right to move members of the same sex to different room configurations to make the best use of available accommodation.

If an event within a package, which we organise, becomes unavailable we will have the choice of organising an alternative activity (in consultation with you), or making a proportional refund.

You will not be entitled to cancel the booking. If we decide that the event is a subsidiary and not a principal part of any package, we will not be obliged and you will not be entitled to cancel your booking.

Wherever possible we will always try and accommodate reduction in numbers incurring no cost to the group. However should the numbers attending be insufficient to run all or part of the event we reserve the right to charge the group for the minimum numbers required for the event.

Please note that an uneven number of participants in your group may attract a hotel single supplement surcharge. If triple rooms are available at the accommodation we will endeavour to book one for your group. However if a single room has to be booked the group will be liable to pay the supplement as prices are based on shared occupancy.

Pricing

The price of the tour/ event is as detailed on the website / general information. Prices shown are correct at the time of printing and internet loading but please note that the price may change as a result in suppliers of services or other relevant matters pertinent to your booked tour/ event. Nicola Jane Corporate will advise you in writing of any increase in charges payable which must be paid in full prior to the event date. Nicola Jane Corporate reserves the right to change any of the event/ facilities or prices described on the website before the agreement between you and Nicola Jane Corporate is concluded. All Price’s are inclusive of current levels of VAT, any changes in VAT levels will be reviewed at that time and you will be informed in writing of any additional payments due. Failure to meet these payments will be deemed as an under payment and refunds of the package price will not be applicable. Nicola Jane Corporate reserve the right to change or amend our pricing without prior knowledge and prices are subject to availability at the time of confirmation

Cancellation
If Nicola Jane Corporate changes or cancels an event that has been booked, unless you choose an alternative/tour, any monies paid by you will be returned in full. In the event of an alternative event / tour being booked at a different price to that cancelled then an appropriate refund or further payment will be made as applicable. If we are unable to provide any event or service due to any reason beyond our control, a replacement will be found.
In the event of you canceling for whatever reason a booked tour / event with Nicola Jane Corporate, you must do so in writing 5 weeks or longer before the first event commences, in canceling the booking within this period you will forfeit any deposit paid to us. Furthermore, in the event of canceling the whole reservation more than 5 weeks before the event date, any monies already paid by individual group members will also be non-refundable. In the event of cancellation 5 weeks or fewer days before the tour / event the entire cost shall be payable. Nicola Jane Corporate will not be responsible for the cancellation of any event due to force majeure.
If any payments have been made up to the final payment date as detailed in your booking confirmation and we do not hear from the group leader the booking will be closed off with these figures. After this date if we do not hear from the group leader within 2 weeks of the weekend date we will be forced to cancel the weekend in respect of our suppliers and any payments made to said supplier prior to this date will be non-refundable. The suppliers may then fill your allocated slots at their discretion. All monies at this stage will be non-refundable and to re-establish the booking you must place a further deposit and the full booking cost.

In the event of an extension on your final payment date, all payments received on your booking up to the original final payment date and new final payment date are non-refundable.

Feedback

If you have a feedback regarding any element of your booking you must notify us in writing. If any challenges arise during your weekend you must telephone Nicola Jane Corporate on the emergency contact number supplied immediately. If you fail to call and report any such incidents or issues we will not consider ourselves to be liable for those challenges or feedback. All concerns must be forwarded in writing to us within 7 days after the commencement of your event. We will acknowledge receipt of your correspondence and we will respond to all feedback in written format within 28 days. Any feedback or challenges raised and not informed to Nicola Jane Corporate in writing outside of the 7 day period, with acknowledgement from Nicola Jane Corporate will not be considered.

Holding of Funds

Monies paid to us are held in a separate account until after you have participated with your arrangements in keeping with the package holidays & Tour Regulation 1992 or until the services that provide your arrangements have been paid in advance

General

The term "centrally located hotel" means up to a 10-15 minute drive from the designated city/town centre

Behaviour

Upon booking a Nicola Jane Corporate weekend it is understood that you agree to behave in a safe and courteous manner at all times. You also agree to obey the proper instructions of any activity leader, and will dress and equip yourself suitably for any event. You also agree to use safety equipment as instructed and not tamper with or abuse it. You also agree to compensate our contractors or us for any damage or loss of revenue caused by you in the course of an event.

You are required and each member of the party is personally responsible to arrive on time for all events, obey all instructions given to you by activity leaders and dress appropriately for your activities. You are not permitted to arrive at any accommodation or activity suppliers under the influence of alcohol or drugs under any circumstances.

Nicola Jane Corporate will not be liable for any refusal of entry or participation in an activity if your group fails to conduct yourselves as detailed in this clause.

Nicola Jane Corporate are not liable for any refusal of entry or termination of activity due to behaviour deemed unacceptable by the activity leader or venue manager/representative
 
Certain accommodation and event suppliers insist on a behavioural bond to be deposited by the group on arrival. Management may refuse your group entry without this bond and Nicola Jane Corporate will not be liable for your arrangements if this clause is not adhered to, or if the management refuse entry.

Liability

Some of the events involve a degree of risk to you of physical injury or of damage to property which you accept full liability for. We do not exclude our liability for death of personal injury caused by our negligence or that of our employees, but we do not accept liability for the negligence of any other persons. We do all that we reasonably can to reduce the risk to you. If we have done that and are not negligent, you will take responsibility for any risks involved in participation in any event. We cannot accept liability in any unusual or unexpected circumstances beyond our control, which we could not have avoided even if we had used all care possible. All our suppliers are responsible for your safety with all activities and whilst on there premises. Any event’s or circumstances which we or our supplier could not help, expect or prevent also accept no liability.

All suppliers and venue’s have there own individual liability terms and conditions which you agree to adhere to during your weekend. Copies of the suppliers and venues terms and conditions are available to you. Should you not request a copy off these Nicola Jane Corporate the company will assume you have asked for them from the venue or supplier direct and agree to there terms whilst at the individual venue or during your activity supplier.

Age Restrictions and Limits

It is not down to us, Nicola Jane Corporate, to ensure all members of your party are of an age to participate in all activities. The group leader takes this responsibility when booking and must ensure all members of their party are over 21 years of age. If this is not the case and some members of your party fall into this age category, please check with us that the events you book can accommodate the younger members of your party. If this is not checked prior to your booking and you encounter problems during your weekend, Nicola Jane Corporate cannot be made responsible. Some of our activities may not be participated in due to height / weight / pregnancy / disability / medical restrictions. It is your responsibility to ask us if there are any of the aforementioned restrictions regarding any events you may have booked with Nicola Jane Corporate. Failure to do so may result in group members not being able to participate in certain events and Nicola Jane Corporate will not be held responsible and will not provide a refund in these circumstances.

Law & Jurisdiction

This agreement is governed by English Law and shall be subject to the jurisdiction of the court of England and Wales.
